SOUTH PARK STICK OF TRUTH PUBLISHER GOES DOWN, GAME MOVES TO DIFFERENT PUBLISHER??

So, I had written about the demise of THQ, the game publisher for the upcoming South Park: Stick of Truth game, and we pretty much predicted what is going on now but I don’t think even I could have figured this. So, with THQ now dead, the company has evidently given the rights to publish the South Park game over to Ubisoft(Assassin’s Creed) according to Wired.com. But, I’m not buying it as South Park Studios is said to be wanting the rights of the game back to them so that they can find a publisher of their own choosing. According to Gamespot, this whole thing was actually put in writing:

THQ, which was signed in June 2011, allows it to acquire “all elements of the game and related products” at THQ’s cost in the event of the downtrodden publisher breaching the contract. South Park Studios claims that, under section 365(c)(1) of the Bankruptcy Code, THQ can’t sell the rights to The Stick of Truth to another publisher. THQ, on the other hand, disagrees, and cites a specific clause in its original contract that has been redacted from the public documentation.

I don’t want to comment yet on who I think is right, because I don’t know what the redacted clause is that THQ is referring to, but I do know one thing. There is no chance of this game coming out on March 5, because at the very least unless if some sort of deal is in place, the South Park Studios will at LEAST temporarily hold off on the release of the game until all legal matters are settled. Hell, that’s what a publisher does…if we don’t know who is doing it then guess what?? No game. And I do think Ubisoft could do it, but I think its only fair if the rights holders of the South Park license get first crack. Your thoughts??
